Customs clearance in Mexico

In Mexico the customs law establishes that for the entry or exit of goods to national territory shall perform all acts and formalities relating to the so-called "customs clearance" (set of procedures and mandatory actions before the Customs authorities) by their own owners or consignees of goods or through your broker or broker agent. I.e. any natural or moral person will need invariably hire for an import or export to a broker that you assist you with the necessary formalities at customs, this is a specialty that only customs agents and their staff can and know to perform in accordance with the applicable laws. The customs agent is not a simple acceptance but a true Advisor who is also responsible for solidarity together with the importer or exporter of the veracity and accuracy of the data and information provided to the authority to determine the correct classification of goods, requirements and permits documentary that they must be covered and all contributions and taxes on foreign trade that must be paid.

Therefore the customs clearance process requires on our part that we advise them and see exactly with regard to:

  • The correct tariff classification of goods: code established according to the law on the General tax of import and export of Mexico.
  • The determination of tariff and non-tariff requirements: permits, NOMs, phytosanitary regulations, and animal health etc.
  • The possible applications of benefits by the use of tariff preferences arising from the international treaties signed by Mexico with various countries
  • Calculation of taxes on foreign trade: regularly is a percentage to be paid as tax to foreign trade calculated on the customs value of goods (called ad-valorem), DTA (right of customs procedures) and taxes mainly.
  • Determination of the customs regime for which the goods are used which is the legal status that will have the goods in Mexico or with which will travel overseas.
  • Revision in customs of goods (called previous customs) against invoice, list of packaging and other documents, which are very important to determine the data to a custom.
  • Processing of the single window (VUCEM) and the COVES
  • Elaboration of the Customs Declaration and its timely payment.
